Patent term extension exists because a drug patent runs for twenty years while the product cannot legally be sold for much of it.
FDA review consumes term. A compound patented in 2010 and approved in 2021 spent eleven of its twenty years generating no revenue.
PTE gives some of that back — up to five years, under 35 U.S.C. 156, added to the end of the patent's term.
But the constraints are severe. One patent per product, a 14-year cap, and a 60-day filing deadline that cannot be extended.
Why the extension exists
A patent term runs from filing, but a regulated product cannot be sold until it is approved, and the gap between those two events is often more than a decade.

A compound filed in 2010 and approved in 2021 had nine years of term left, on a twenty-year patent, to recover development costs that ran into the hundreds of millions.
Hatch-Waxman was the bargain struck around that. Sponsors received term restoration for regulatory delay; generic manufacturers received an abbreviated approval pathway and a safe harbour for pre-expiry development work.
Which is why the 14-year cap exists. The restoration is designed to guarantee a period of post-approval exclusivity, not to reward long patents with longer ones — and the cap is what enforces that.
What PTE is and is not

They stack. A pharmaceutical patent can carry substantial PTA for slow examination and then PTE for slow approval, running well past twenty years from filing.
PTE is narrower in what it extends. PTA lengthens the whole patent. PTE extends only the claims covering the approved product and its approved uses — other claims expire on the original date.
The interim extension
A patent can expire while FDA review is still running, and there is a mechanism for that narrow case.

It is applied for during review, not after. An interim extension cannot resurrect a patent that has already expired, so the application has to be made while the patent is still alive.
It does not replace the 60-day PTE application. Once approval arrives, the ordinary application must still be filed within 60 days, and interim extensions granted along the way do not extend that deadline.
The scenario is rare but expensive when missed. A patent that lapses weeks before approval takes the entire post-approval exclusivity with it, and no subsequent filing recovers it.

"First permitted commercial marketing" excludes a great deal. A new formulation or new indication for an already-approved active ingredient generally does not qualify, because the product has been marketed before.
Medical devices qualify through premarket approval, the lengthy pathway. The shorter 510(k) clearance route rarely produces enough delay to matter.
The calculation
Regulatory review period = half the testing phase + all of the approval phase.

The 14-year cap is what usually binds, not the five-year maximum. A patent with plenty of term left at approval gets little or no extension, because it already provides close to fourteen years of post-approval exclusivity.

Patent B lost 1.5 years of entitlement to the cap. It was entitled to four years and received about two and a half, because it already had substantial term remaining at approval.
The cap is doing exactly what it was designed to do — guaranteeing a period of post-approval exclusivity rather than rewarding long patents with longer ones.
Generic entry and the extended date
The extended expiry date sets when generic competition can begin, which is why the choice of patent is a commercial decision rather than an administrative one.

Patent term and regulatory exclusivity are separate systems. Data exclusivity and orphan-drug exclusivity run on their own clocks and can outlast or be outlasted by the patent, so the effective entry date is the later of the two.
Model both together. Extending a patent to a date already covered by regulatory exclusivity adds nothing commercially.
Choosing which patent to extend
One per product, and the decision is permanent.

Composition patents are usually the right choice, because they are hardest to avoid. But the arithmetic can point elsewhere: a composition patent already near the 14-year cap gains little, while a later-filed formulation patent might gain the full five years.
Compare extended expiry dates, not entitlements. The question is which extended patent produces the latest useful exclusivity, and that depends on each patent's base date, its PTA, and how the cap applies to each.
Decide before the 60 days start running. The clock begins at approval, and the analysis takes longer than most sponsors allow when approval arrives.

Sixty days is short for a decision this consequential. It covers choosing which patent to extend, assembling the regulatory chronology, and preparing the application.
Prepare before approval. Sponsors who wait for the approval letter to start thinking are working against a clock that does not stop for analysis.
Interim extensions exist where a patent would expire during a long review, but they have their own requirements and do not rescue a missed 60-day deadline.

The European SPC is a separate right, not an extension of the patent, though it works the same way commercially. It is granted country by country, so a product needs SPCs filed in each market that matters.
The paediatric six months is small in percentage terms and large in absolute revenue on a successful product, which is why paediatric investigation plans are completed even where the clinical value is limited.
Filing deadlines differ everywhere. SPC applications have their own windows, and a team focused on the US 60-day deadline can miss them.

Pharmaceutical patents under extension are among the least likely to be abandoned, but the obligation does not disappear because the term was extended.
Patent term extension: the checklist
- Confirm eligibility early — regulated product, patent in force, first permitted commercial marketing, not previously extended.
- Identify every candidate patent covering the product, a method of using it, or a method of manufacturing it.
- Calculate the extension for each candidate separately, applying both the five-year maximum and the 14-year cap.
- Compare extended expiry dates, not entitlements. The cap can reverse the ranking.
- Weigh scope alongside dates. A composition patent expiring earlier may still beat a formulation patent expiring later.
- Do the analysis before approval arrives. Sixty days is not enough time to start from scratch.
- Diarise the 60-day deadline from the approval date the moment approval is granted. It cannot be extended.
- Assemble the regulatory chronology in advance — investigational exemption date, application submission, approval.
- Check the FDA's published review period determination and challenge it if the dates are wrong.
- Track SPC and foreign extension deadlines separately. They have their own windows and will not wait for the US filing.
